As an employer in the U.S. you may only hire persons who are eligible to legally work in the United States. The Form I-9 (Employment Eligibility Verification Form) is provided by the federal government for that purpose, and you are required to fill out Section 1 of the Form I-9 for every new employee, within the first day of hire and Section 2, within three days of hire.

If your Form I-9s are not in full compliance, your organization is at risk of costly fines or penalties. Fines and penalties are enforced by Immigrations and Customs Enforcement (ICE), a division of the Department of Homeland Security (DHS). Failing to comply with Form I-9 regulations can result in fines ranging from $100 to $1,100 per employee, and other courses of action including jail time or debarment from government contracts.
